Terms of Service

Effective June 5, 2026

Please read these Terms of Service ("Terms") carefully before using FetchBack at https://fetchback.ai ("Service"). By using the Service, you agree to be bound by these Terms.

1. The Service

FetchBack is an AI-powered shopping recommendation engine that:

• Searches multiple retailers for products matching your query
• Compares prices and identifies potential savings
• Recommends credit cards based on publicly available reward rate data
• Provides links to third-party retailer websites where you can complete purchases

FetchBack is a recommendation engine only. We are not a retailer, marketplace, financial institution, financial advisor, credit card issuer, or payment processor. We do not sell products, process payments, issue credit, or manage any financial accounts. All purchasing and financial decisions are made solely by the user.

FetchBack does not guarantee any specific rewards outcome. Our card recommendations are made on a best-effort basis using publicly available reward rate data. The actual rewards, points, miles, or cash back you receive on any transaction are determined solely by your card issuer and the merchant, not by FetchBack. By using this Service you acknowledge and agree that FetchBack's role is limited to providing recommendations and that FetchBack bears no responsibility for the rewards actually earned or not earned on any purchase.

2. Eligibility

You must be:

• At least 18 years old (or the age of majority in your jurisdiction)
• A resident of the United States
• Capable of entering into a binding contract

By using FetchBack, you represent that you meet these requirements.

3. Your Account

When you create an account:

• You are responsible for maintaining the security of your credentials
• You are responsible for all activity under your account
• You must provide accurate information
• You may not share accounts or create accounts on behalf of others without authorization

We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Credit Card Wallet and Reward Rate Recommendations

The FetchBack card wallet stores the name and last 4 digits of your credit cards alongside reward rate data from third-party sources (RewardsCC).

Important limitations on card data:

• We do not store full card numbers, CVV codes, or expiration dates
• We do not have access to your actual credit card accounts
• Reward rates shown are sourced from third-party data providers and may not reflect your current card terms, recent issuer changes, or promotional modifications
• We are not affiliated with, endorsed by, or in any way connected to any card issuer, card network, or financial institution
• Card recommendations are suggestions only — always verify reward rates directly with your card issuer before making any purchasing or financial decision

Merchant Category Codes (MCC) and reward determination:

FetchBack makes best-effort attempts to identify the merchant category and applicable reward rates for a given purchase. However, you expressly acknowledge and agree that:

1. MCC codes are assigned by card networks and merchants, not by FetchBack. The reward category applied to any transaction is determined by the MCC code assigned to the merchant at the time of the transaction, which is outside FetchBack's knowledge or control.

2. Card issuers make final reward determinations. The actual rewards, points, miles, or cash back credited to your account on any transaction are determined solely by your card issuer in accordance with your cardholder agreement. FetchBack has no ability to influence, guarantee, or verify the rewards your issuer will apply to any specific transaction.

3. MCC codes can be inconsistent. The same merchant may be assigned different MCC codes depending on the transaction type, point of sale system, online versus in-store purchase, or other factors outside FetchBack's control. A merchant FetchBack identifies as "Grocery Stores" may be processed by your card issuer under a different category.

4. Reward rates change. Card issuers may modify reward rates, bonus categories, spending caps, and promotional offers at any time. FetchBack's data provider (RewardsCC) updates rates regularly but cannot guarantee real-time accuracy.

5. FetchBack is not liable for missed, reduced, or incorrect rewards. If a transaction earns fewer rewards than FetchBack recommended, or earns rewards in a different category, or earns no rewards at all, FetchBack bears no liability whatsoever. Your sole recourse for any reward dispute is with your card issuer.

6. Spending caps and limits apply. Many reward categories have annual or quarterly spending caps after which the bonus rate no longer applies. FetchBack displays known caps where available but cannot guarantee this information is current or complete.

By adding a card to FetchBack and using our card recommendations, you acknowledge that you have read and understood these limitations and agree that FetchBack's card optimization feature is a convenience tool only, provided on an informational basis with no warranty of any kind regarding rewards outcomes.

5. AI Recommendations — Informational Purposes Only

FetchBack uses artificial intelligence to generate product recommendations, shopping summaries, and card optimization suggestions. All AI-generated content is provided for informational and convenience purposes only.

You expressly acknowledge and agree that:

• FetchBack is a recommendation engine, not a financial advisor, investment advisor, credit counselor, or licensed financial professional of any kind
• No content generated by FetchBack constitutes financial advice, credit advice, investment advice, or a recommendation to engage in any financial transaction
• AI recommendations may contain errors, omissions, outdated information, or inaccuracies
• AI category detection for reward purposes is a best-effort estimate and is not a guarantee of how a transaction will be classified by your card issuer
• You make all purchasing and financial decisions independently and bear sole responsibility for those decisions
• FetchBack is not responsible for any outcome — financial or otherwise — resulting from acting on FetchBack's recommendations
• Product prices, availability, and reward rates change in real time and may differ materially from what is displayed

FetchBack's recommendation engine is not a substitute for reading your cardholder agreement, consulting your card issuer, or seeking professional financial advice.

6. Affiliate Relationships and Compensation

FetchBack participates in affiliate programs. When you click product links and make purchases, we may earn a commission.

We disclose that:

• We participate in the Amazon Associates Program and may earn from qualifying purchases
• We may participate in affiliate programs with other retailers
• Affiliate relationships do not influence our ranking algorithms or recommendations
• Commissions are paid by retailers, not by you — you pay the same price whether you use FetchBack or not

This disclosure satisfies FTC requirements under 16 CFR Part 255.

7. Third-Party Websites and Products

FetchBack provides links to third-party retailer websites (Amazon, Best Buy, Walmart, etc.). When you click these links:

• You leave FetchBack and are subject to the third party's terms and privacy policy
• FetchBack has no control over third-party content, prices, availability, or fulfillment
• FetchBack is not responsible for any transaction, dispute, or issue arising from a third-party purchase
• Product descriptions, images, and prices on third-party sites may differ from what FetchBack displays

Your purchase is entirely between you and the retailer. Any disputes, returns, warranties, or customer service issues are between you and the retailer.

8. Prohibited Uses

You may not use FetchBack to:

• Violate any applicable law or regulation
• Scrape, crawl, or systematically extract data from the Service
• Reverse engineer, decompile, or attempt to extract source code
• Use automated tools to submit searches or interact with the Service
• Impersonate another person or entity
• Interfere with the security or performance of the Service
• Use the Service for commercial purposes without written permission
• Attempt to manipulate product rankings or affiliate tracking

9. Intellectual Property

The FetchBack name, logo, product design, and underlying software are owned by FetchBack Limited Liability Company and protected by intellectual property laws. You may not use our brand, copy our interface, or reproduce our content without written permission.

User-submitted content (searches, feedback) remains yours but you grant us a license to use it to operate and improve the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

FETCHBACK IS A RECOMMENDATION ENGINE ONLY. ALL RECOMMENDATIONS ARE PROVIDED FOR INFORMATIONAL AND CONVENIENCE PURPOSES SOLELY. NOTHING ON THIS SERVICE CONSTITUTES FINANCIAL ADVICE, CREDIT ADVICE, OR A GUARANTEE OF ANY REWARDS OUTCOME.

WE SPECIFICALLY DISCLAIM:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any guarantee that prices displayed are current, accurate, or the lowest available
• Any guarantee that products are available, authentic, or as described
• Any guarantee that AI recommendations are accurate, complete, or optimal
• Any guarantee of uninterrupted or error-free service
• Any guarantee that a recommended credit card will earn the displayed reward rate on any specific transaction
• Any guarantee that a merchant will be assigned the MCC code FetchBack predicts
• Any guarantee that a card issuer will apply bonus rewards to any specific transaction
• Any guarantee that reward rates, bonus categories, spending caps, or promotional offers displayed are current or accurate
• Any representation that FetchBack is affiliated with, endorsed by, or in any way connected to any card issuer, card network, bank, or financial institution

PRICE AND REWARD INFORMATION IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. THE ACTUAL REWARDS EARNED ON ANY TRANSACTION ARE DETERMINED SOLELY BY YOUR CARD ISSUER AND THE MERCHANT'S ASSIGNED MCC CODE, BOTH OF WHICH ARE ENTIRELY OUTSIDE FETCHBACK'S CONTROL. ALWAYS VERIFY REWARD RATES AND PRICING DIRECTLY WITH YOUR CARD ISSUER AND THE RETAILER BEFORE MAKING ANY PURCHASE DECISION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FETCHBACK LIMITED LIABILITY COMPANY AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, punitive, or consequential damages of any kind
• Lost profits, lost savings, lost rewards, lost points, lost miles, or lost cash back
• Damages arising from purchases made through third-party retailers
• Damages arising from reliance on AI recommendations or card optimization suggestions
• Damages arising from inaccurate, outdated, or incomplete price or reward rate information
• Damages arising from a card issuer's decision to apply a different reward rate, reward category, or no rewards to any transaction
• Damages arising from a merchant being assigned a different MCC code than FetchBack predicted
• Damages arising from reward rate changes, promotional expiration, spending cap application, or any other issuer-side determination
• Damages arising from the difference between FetchBack's displayed reward estimate and the rewards actually credited by a card issuer
• Damages arising from third-party data provider errors (including RewardsCC)
• Damages exceeding the amount you paid us in the 12 months preceding the claim (or $50 if you have not paid us anything)

FETCHBACK'S ENTIRE LIABILITY FOR ANY CLAIM ARISING FROM THE CARD OPTIMIZATION OR REWARD RECOMMENDATION FEATURES IS LIMITED TO $50. YOU ACKNOWLEDGE THAT THIS LIMITATION IS REASONABLE GIVEN THAT FETCHBACK IS A FREE RECOMMENDATION SERVICE WITH NO CONTROL OVER CARD ISSUER DECISIONS.

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR CERTAIN DAMAGES — IN THOSE JURISDICTIONS, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify and hold harmless FetchBack, FetchBack Limited Liability Company, and any affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from Settings → Danger Zone.

Upon termination:

• Your right to use the Service ends immediately
• We will delete your data per our Privacy Policy
• Provisions that by their nature should survive termination (disclaimers, limitation of liability, indemnification) will survive

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Informal resolution first: Before filing any legal claim, you agree to contact us at legal@fetchback.ai and give us 30 days to resolve the issue informally.

Arbitration: If informal resolution fails, disputes will be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, not in court. You waive the right to participate in class action lawsuits.

Small claims exception: Either party may bring individual claims in small claims court.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email and by posting notice on the Service. Continued use after the effective date of changes constitutes acceptance.
